Demolition Ordered on Two Neglected Structures

Following a morning Street Improvement workshop during which contractor Allen Keller updated the Council on the status of the project, the Horseshoe Bay City Council met for its monthly meeting.

Council heard from Nelda Hope, Chairman of the Llano County Library Board, who informed them of a $20,000 shortfall in funding due to state and county cutbacks. Council approved a $5,000 contribution to the board.

With no objections, the Council approved a name change for Skywater Over Horseshoe Bay to Summit Rock. The Council also passed a resolution to waive development and utility fees for HSB Space Center One, LP as well as an ordinance approving an amendment to the Utility Fund Budget for the Summit Rock Water Tank in the amount of $1,800,000 and $600,000 for the Summit Rock Lift Station.

Council considered three dilapidated structures located in Horseshoe Bay and discussed what reasonable action should be taken as each had been identified as possible public nuisances. The owner of first structure considered, which is located on 6th Street, petitioned the Council to allow him to have 30 days to come up with a plan of action and then, once the plan was in place, have regular check ups with the city to ensure that progress was being made. The Council agreed, gave the landowner 30 days to produce a plan and then 270 days, or 9 months, to complete the project. If it is not completed in that time frame, or progress is not being made, the Council will order the structure demolished.

Two other properties were considered, one located on 52ndStreet and one on 22nd Street. Both have been abandoned; one has a lien and the other the owners are deceased and the heirs have refused to assume ownership. On the first, it was decided to order demolition within 60 days so that the lien holder could determine the best way to proceed; on the second they were given 30 days since there were no known owners.

Council considered an ordinance to extend moratoriums on new construction on Zone 13 Caprock Zone and a portion of Zone 14 Horseshoe Bay Boulevard PD Zone. With no objections from the public or the Council, they agreed to extend that for two more years.

An amendment to add garage sale regulations was passed, with the following restrictions: a (no-cost) permit would be required, only one garage sale allowed per year with a three day maximum time frame, and only between the hours of 8am and 5pm. The rules will also limit group garage sales to three families. Those found in violation of the new rule will face a fine of up to $2,000, as determined by the municipal court judge. Permits will be available on the city website soon.

During the discussion regarding garage sales, Councilman Tom Schersahl, pointed out that hostess parties, such as those selling make-up, jewelry, or food items by catalog, were prohibited according to the city’s ordinances. The regulation falls under the umbrella of the prohibiting of home-based business and includes any product sold out of the home that is not made on premises. The rule was established to prevent full-time home based businesses to be run out of one’s home. All of the council members acknowledged that those types of hostess parties occur in HSB and that because they are not full-time businesses that the matter needs to be revisited at a future meeting.
